Chapter 7 & Chapter 13

TYPES OF BANKRUPTCY

Bankruptcy can provide an opportunity to get a fresh financial start and end the constant stress of financial problems. We understand that filing for bankruptcy is a big step, and you probably have many questions and fears.

At Express Bankruptcy Solutions, we know that you would pay your debts if you could and have mixed feelings about bankruptcy. Contrary to what debt collectors may have told you, the fact that you are not currently able to pay your debts despite your best efforts to do so does not mean you are a bad person or a criminal. The Constitution of the United States provides us the right to file bankruptcy, as do both federal statutes and the laws of Massachusetts.

Our experienced bankruptcy attorneys will walk you through the process, address your concerns and guide you to the debt solution that makes the best sense for you and your family.

A message from Ellen... Owner and CEO

I say welcome, and mean it, but I know you would love to be doing something else right now, anything but reviewing Massachusetts bankruptcy lawyer sites. I want you to know that I know how you are feeling from personal experience.  In 2011 I was in dire financial straits and had to modify my home loan in order to get out from under the burden of a mortgage payment I couldn’t afford.  I later also had to file a ch. 7 bankruptcy petition in order to stop a foreclosure on a second property that I owned.  While the economy was failing in the years previous to my financial crisis, I had made some poor financial choices that led me to the point of financial desperation.  I felt desperate, embarrassed and guilty.  I was raised to be responsible, pay my bills and do the right thing.  I had worked 2 jobs while pregnant in law school and I couldn’t believe that after all of my efforts I had been brought to this point. Being an attorney made these feelings of failure even worse for me.

Perhaps your story now is similar to what I went through 10 years ago and you can relate to some or most of it. I want you to know if you are drowning in a sea of debt like I was, bankruptcy can be the life raft you need and there’s no reason to feel guilty about that.  I have since rebuilt my credit and my life and I’m excited to now be able to help people who are in the same situation I was in.  After all, that is what the bankruptcy laws were designed to do – allow you to start over.

OUR SERVICES

Chapter 7 Bankruptcy

Chapter 7 fillings generally quicker, easier and less expensive than a Chapter 13 or Chapter 11. If your only financial problems are general unsecured debt, and you qualify for Chapter 7, it is usually going to be the best choice.

Chapter 13 Bankruptcy

There are several situations where a Chapter 13 is preferable to a Chapter 7. A Chapter 13 bankruptcy is the only choice if you are behind on your mortgage or business payments and you want to keep your property, either in Massachusetts or another state, at the end of the bankruptcy process.
